16. Competitive Activity and Automated Monitoring

These Terms of Service apply to all websites, subdomains, and digital assets owned or operated by the Credit Union, including youracu.org. Our real-time financial products, rate sheets, fee structures, and algorithmic metrics located at, or derived from, these sites (collectively, "Proprietary Rate Data") are proprietary to the Credit Union. If you do not agree to these Terms of Service, you may not access our systems or content. You agree that you will not, and will not cause or permit any third party to:

  1. Competitor Access: Access, monitor, view, or extract data from any part of our sites if you are a direct or indirect competitor, or are acting on behalf of, as a contractor for, or under the instruction of a competitor, for market research, price optimization, rate monitoring, or competitive analysis.
  2. Automated Rate Scraping and AI Training: Use any automated system, software, script, bot, spider, crawler, screen scraper, or artificial intelligence tool (including machine learning models, price-tracking agents, or large language models) to extract, harvest, index, or monitor pricing, rate tables, loan or dividend yields, or service metrics listed on this site.
  3. Data Commercialization: Copy, aggregate, distribute, or otherwise use Proprietary Rate Data to build, feed, train, fine-tune, or maintain any external database, competitive intelligence platform, dynamic pricing engine, or algorithmic model.
  4. Security Circumvention: Bypass, disable, or circumvent any technical security measure, rate limit, IP address block, JavaScript challenge, or web application firewall the Credit Union uses to protect its data.

17. Proprietary Rate Data

All content, features, and functionality available on our sites, including the design, layout, look, appearance, graphics, and compilation of the Proprietary Rate Data, are the exclusive intellectual property of the Credit Union and are protected by copyright, trademark, and trade secret laws. Unauthorized compilation or extraction of Proprietary Rate Data for commercial use is a willful infringement of the Credit Union's intellectual property rights and unauthorized access to its protected systems.

18. Remedies and Injunctive Relief

  1. Material Breach: Any violation of Section 16 is a material breach of these Terms of Service and unauthorized access to the Credit Union's protected computer systems under applicable computer abuse laws.
  2. Injunctive Relief: You acknowledge that a breach of Section 16 will cause the Credit Union irreparable harm for which money damages alone would be inadequate. The Credit Union may seek immediate injunctive relief and specific performance in any court of competent jurisdiction to stop unauthorized scraping or monitoring.
  3. Indemnification: You agree to indemnify, defend, and hold harmless the Credit Union, its officers, and its technology infrastructure partners from any claims, liabilities, losses, costs, or data restoration expenses (including reasonable attorneys' fees) resulting from your use of unauthorized AI crawlers, bots, or scraping tools.

19. Severability

If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions of these Terms of Service will remain in full force and effect.
